<\/span>The\u00a0death penalty<\/a> refers to capital punishment, by which a criminal is put to death by a legitimate authority for serious crimes against human life and the common good.<\/span><\/p>\nOnly a legitimate court of law has the right, in the eyes of the Church, of sentencing someone to capital punishment. \u201cLegitimate public authority has the right and duty to inflict penalties commensurate with the gravity of the crime.\u201d (CCC, 2266)<\/a> <\/span><\/p>\nTo understand where the Church is today<\/strong>, we must first look at the historical justifications<\/strong>\u2014the traditional arguments for the state\u2019s right to punish\u2014and contrast them with the modern development of Catholic Social Teaching.<\/span><\/p>\nThe Early Church: A Tension Between State and Sanctity<\/span><\/h2>\n
<\/span>Unlike\u00a0other issues such as abortion<\/a>, which received absolute condemnation from the earliest days of the Church, pronouncements on the death penalty reflected a complex tension. While early Christians abhorred killing\u2014often preferring martyrdom over resistance\u2014they recognized the state\u2019s duty to maintain order. The Medieval Tradition: Protecting the Common Good<\/span><\/h2>\n
<\/span>During the Middle Ages, the focus shifted toward the state\u2019s duty to protect the \u201cCommon Good.\u201d<\/span><\/p>\n\n- St. Thomas Aquinas argued that rebuking those who refuse to obey God\u2019s laws with criminal sanctions was a matter of justice\u00a0 (Summa Contra Gentilles, Book 3, Chapter 146)<\/a>, and the state may execute dangerous criminals to protect the common good, comparing it to amputating a diseased limb to preserve the health of the body. <\/span>In 1995, Pope St. John Paul II shifted the conversation from the rights of the state to the realities of the penal system. He argued that if we can protect the common good without taking a life, we must.<\/span><\/p>\n\u201cToday… as a result of steady improvements in the organization of the penal system, such cases [of absolute necessity] are very rare, if not practically non-existent.\u201d (Evangelium Vitae, 56)<\/a> <\/span><\/p>\nPope Benedict XVI furthered this<\/strong>, especially during his address to Africa, \u201cI draw the attention of society\u2019s leaders to the need to make every effort to eliminate the death penalty and to reform the penal system in a way that ensures respect for the prisoners\u2019 human dignity.\u201d (Africae Munus, 83)<\/a><\/span><\/p>\nWhile his predecessors focused on the practical reality that modern prisons make the death penalty unnecessary for safety, Pope Francis has clarified the theological core of the issue<\/strong>. Current Church Teaching

<\/span>In light of this development, the Catechism was formally changed in 2018. The full revised paragraph reads:<\/span><\/p>\n\u201cRecourse to the death penalty… was long considered an appropriate response… Today, however, there is an increasing awareness that the dignity of the person is not lost even after the commission of very serious crimes… Consequently, the Church teaches, in the light of the Gospel, that \u2018the death penalty is inadmissible because it is an attack on the inviolability and dignity of the person\u2019<\/strong>\u201d.
